PTI wins Reserved seats case judgement in supreme court of Pakistan

Chief Justice of Supreme Court of Pakistan Qazi Faez Isa headed the bench.

The Supreme Court of Pakistan has given a reserved verdict on the petition related to the reserved seats of the Sunni Ittehad Council.

A 13-member full court bench headed by Chief Justice of Pakistan Qazi Faiz Isa delivered the verdict.

In the full court bench, Justice Syed Mansoor Ali Shah, Justice Muneeb Akhtar, Justice Yahya Afridi, Justice Aminuddin Khan, Justice Jamal Khan Mandukhel, Justice Muhammad Ali Mazhar, Justice Ayesha A. Malik, Justice Athar Minullah, Justice Syed Hasan Azhar Rizvi, Justice Shahid Waheed, Justice Irfan Saadat Khan and Justice Naeem Akhtar Afghan were also present.
The decision came from a majority of 8 judges

Chief Justice of Pakistan Qazi Faiz Isa said that the decision is a majority of 8, which was written by Justice Mansoor Ali Shah.

Justice Mansoor Ali Shah, Justice Athar Minullah, Justice Shahid Waheed, Justice Muneeb Akhtar, Justice Muhammad Ali Mazhar, Justice Ayesha Malik, Justice Hasan Azhar Rizvi, Justice Irfan Saadat was the majority decision.

Chief Justice of Pakistan Qazi Faiz Isa, Justice Jamal Mandukhel, Justice Naeem Akhtar Afghan, Justice Aminuddin Khan opposed the petitions.

Chief Justice of Pakistan Qazi Faiz Isa said that I will ask Justice Mansoor Ali Shah to pronounce the verdict.

After which Justice Mansoor Ali Shah delivered the verdict and said that the decision of Peshawar High Court has been declared null and void, the decision of the Election Commission is against the constitution.

He said that non-observance of election symbol does not stop any political party from elections, Pakistan Tehreek-e-Insaf was and is a political party.

The Supreme Court has said in the decision that PTI is entitled to get specific seats, Tehreek-e-Insaf should list the names of its specific people within 15 days of this decision.

Supreme Court ordered to give reserved seats for women and minorities to PTI.

The decision has said that specific seats in Punjab, Khyber Pakhtunkhwa and Sindh should be given to PTI.

Supreme Court declared Tehreek-e-Insaf as PTI in Parliament and Provincial Assemblies.

The Supreme Court rejected the appeals of the Sunni Ittehad Council.

The Supreme Court has said in the judgment that the other 41 candidates can also give certificates within 14 days that they were candidates of the Sunni Ittehad Council. The Sunni Ittehad Council cannot take reserved seats according to the constitution. It is fulfilled, the Election Commission has submitted the data of 80 candidates, the right of a party to participate in the election is not lost due to the loss of election symbol.

The Supreme Court has said in its decision that PTI as a party has the legal and constitutional right to get certain seats. From I, it will remain so, PTI’s selected candidates cannot be declared as candidates of any other party or as independent candidates, Justice Yahya Afridi’s dissenting note is also included in the judgment.

Chief Justice of Pakistan Qazi Faiz Isa said in the judgment that the Election Commission had given its decision by expelling the PTI members, on this basis the decision of the Peshawar High Court is null and void. was declared independent, PTI did not challenge the Election Commission’s decision to be declared independent, the Election Commission did not fulfill its responsibility, the Election Commission should redistribute the reserved seats, now the elected members of PTI or declare themselves independent or belong to PTI, there should be no pressure on PTI members.
Justice Yahya Afridi’s dissenting note

Justice Yahya Afridi’s dissenting note has also come out with the decision.

Justice Yahya Afridi has said in his dissenting note that the appeals of the Sunni Unity Council are rejected.

In a dissenting note, he has said that the Sunni Unity Council cannot take reserved seats as per the constitution.

Justice Yahya Afridi said in a dissenting note that PTI as a political party fulfills the law and constitution.

The dissenting note also stated that PTI as a party has a legal and constitutional right to get certain seats.
The decision will be broadcast live

The verdict was broadcast live, the cause list was issued by the Supreme Court in this regard.

Before the judgment was delivered, Room No. 1 of the Supreme Court was opened and 13 chairs were installed for the full bench.

Attorney General Mansoor Usman Awan, Election Commission’s lawyer Sikander Bashir, independent candidates’ lawyer Salman Akram Raja were present in the court room when the verdict was delivered.
